Information on personal data processing – Purchase Contract

BASIC SUMMARY

Fine Promo s.r.o. processes your personal data because it is necessary for the performance of the contract with you pertaining to the sale of a product (or for the implementation of measures taken prior to the conclusion of such a contract) and personal data necessary for the fulfilment of the company’s duties under public law.

1.3. The Controller did not appoint a data protection officer.

  1. LEGAL BASIS FOR PERSONAL DATA PROCESSING

2.1. The legal basis for the processing of your personal data is especially the fact that this processing is necessary for:

2.1.1. fulfilment of the contract concluded between you and the Controller or the adoption of measures by the Controller prior to the conclusion of such a contract within the meaning of Art. 6 (1)(b) of Regulation 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “Regulation”);

2.1.2. fulfilment of statutory duties applicable to the Controller within the meaning of Art. 6 (1)(c) of the Regulation, in particular, the fulfilment of the obligations imposed on the Controller by generally binding legal regulations, especially by Czech Act No. 235/2004 Coll., on value added tax, as amended, Czech Act No. 586/1992 Coll., on income taxes, as amended and Czech Act No. 563/1991 Coll., on accounting, as amended.

  1. PURPOSE OF PERSONAL DATA PROCESSING

3.1. Your personal data are processed for the performance of the contract between you and the Controller, including the delivery of the product and the resolution of claims of defects, or implementation of measures by the Controller prior to conclusion of such a contract and also fulfilment of the related public-law duties by the Controller.

3.2. The Controller does not use automated individual decision-making within the meaning of Article 22 of the Regulation.

  1. PERIOD OF STORAGE OF PERSONAL DATA

4.1. Your personal data shall be processed for the duration of the effects of the rights and obligations following from the contract, and then for the period necessary for the purpose of archiving required by generally binding legal regulation, however, not longer than for the period stipulated by generally binding legal regulation.

  1. OTHER RECIPIENTS OF PERSONAL DATA

5.1. Other recipients of your personal data will include transport companies and other parties participating in the delivery of the product or payment procedures under the Purchase Contract and parties providing technical services for the Controller that are related to the operation of the e-shop, including software operations and data storage.

5.2. Recipients of your personal data processed for the purpose of performance of statutory obligations may also include authorities such as the tax administration or other competent authorities in cases where the Controller is obliged to provide the data on the basis of generally binding legal regulations.

5.3. The Controller does not intend to transfer your personal data to a third country (outside EU) or to an international organisation.

  1. RIGHTS OF THE DATA SUBJECT

6.1. Under the terms and conditions stipulated in the Regulation, you have the right to request from the Controller access to your personal data, the right to rectification or erasure of your personal data or restriction of their processing, right to object to processing of your personal data, as well as the right to portability of your personal data (performance of a contract).

6.2. If you think that the processing of your personal data violated or violates the Regulation, you also have the right to lodge a complaint with a supervisory authority.

6.3. You are not obliged to provide personal data. Provision of your personal data is a necessary requirement for the conclusion and performance of a contract; without provision of your personal data the contract cannot be concluded or performed by the Controller.
